In a concurring opinion released on Thursday, Justice Ketanji Brown Jackson failed to acknowledge women for the second time in her Supreme Court career, instead using the term “pregnant patients” to describe those affected by Idaho’s popular lifesaving law and the Biden administration’s attempt to expand the 1986 Emergency Medical Treatment and Labor Act (EMTALA).

Despite claiming to represent women, Jackson joined Chief Justice John Roberts and Justices Amy Coney Barrett, Brett Kavanaugh, Sonia Sotomayor, and Elena Kagan in deciding not to rule on the Biden administration’s attempt to use EMTALA to advance its abortion extremism in pro-life states. In her opinion, Jackson reduced the unique individuals who are biologically designed to conceive and birth children to “pregnant patients,” refusing to use the accurate label “women.”

Throughout her eight-page opinion, Jackson claimed that Idaho’s law, which has saved hundreds of lives, caused a “months-long catastrophe” and failed to provide clarity and certainty to pregnant patients experiencing emergency medical conditions. She also amplified the Biden regime’s talking point that complications like preeclampsia, preterm premature rupture of the membranes, sepsis, and placental abruption mean women must choose between preserving themselves or their unborn children.

In reality, many women and babies have survived pregnancy complications with proper medical intervention that prioritizes saving both lives. Jackson’s refusal to acknowledge women and her use of feigned ignorance and revisionist leftist activism in her language have become a hallmark of her tenure on the high bench.

Since her confirmation in 2022, Jackson has consistently demonstrated a lack of understanding of biological reality, refusing to define what a woman is and instead claiming she is “not a biologist.” Her actions have been marred by ethics violations and a lack of accountability, further eroding trust in the Supreme Court.
