Biden’s Order Unlikely to Halt Surge of Migrants into U.S.

President Joe Biden’s executive order concerning the United States-Mexico border is unlikely to halt the administration’s mass release of migrants into American communities, an analysis from the American Immigration Council suggests.

This corresponds to about 17,500 migrants arriving at the border weekly — nearly a million a year. Nevertheless, the order includes numerous exemptions for subgroups of migrants who could still seek asylum despite crossing between Ports of Entry.

According to the American Immigration Council, Biden’s DHS is unlikely to cease its extensive release of migrants into the U.S., noting, “If the government cannot solve all these operational issues overnight, it will likely have to continue releasing large numbers of people into the country.”

Recent history indicates that the U.S. will be unable to process everyone through the new, more restrictive procedures, and that a significant number of people will still be released into the United States pending court hearings — even if they may be deemed ineligible for asylum at those hearings. If significant changes are not made to either the number of people entering or the resources available to respond, these practical constraints will become very real, and the government may have to release significant numbers of people into the U.S. with notices to appear in immigration court. During the first six months of this fiscal year, more than 671,000 migrants have been released into the U.S. with Notices to Appear (NTA) before a federal immigration judge at a later date, which in some cases is nearly a decade away.

Those tens of thousands of migrants arriving at the nation’s Ports of Entry with scheduled appointments for release into the U.S. via the CBP One mobile app will still be allowed to enter.

Since its launch last year, the CBP One mobile app has facilitated nearly 600,000 migrants’ entry into American communities — surpassing Wyoming’s population.

Bill Melugin of Fox News reports that even though the order has been effective for roughly two days, it has not curbed mass immigration at the border.

Months ago, Reps. Jim Jordan (R-OH) and Tom McClintock (R-CA) called on DHS Secretary Alejandro Mayorkas to provide a “numerical breakdown of all illegal alien releases at the southwest border since January 20, 2021.”
