The scope of what is a president's professional aka public act is surely determined by the scope of government in the enumerated powers. Those are in the preamble.
If I remember correctly, there is a law on the books that says that members of Congress cannot be arrested or prosecuted for anything while Congress is in session. The law was passed to stop the sort of politically motivated actions incurred to affect votes by rounding up opponents to any given bill up for condideration.
Why is this so hard? It is in the Constitution. The President has immunity until he is impeached for a crime. Then, he can be prosecuted for that crime. Simple.
The president has never been granted 100% immunity. Congress can bring charges against any sitting president for any crime via the impeachment process. However, the president is immune from prosecution from city and state prosecution. Congress must assign a qualified person to lead any prosecution, which has not been done, which means Jack Smith is an illegal prosecutor, which also means AG Garland overstepped his authority.

If the POTUS is denied qualified immunity then that would trickle down to all other Government officials, LEOs, Judges and so on….
