This judge that dismissed the case against Alec Baldwin with prejudice isn't an acquittal. Because the State could appeal her decision to dismiss. There's a chance that it could get revived on appeal, but it cannot be refiled again. And this is another reason why it's unconstitutional to file at least criminal cases in courts in other districts and not in the district where the alleged crime was committed. Because now the State could potentially refile in another district court seeking for other jurisdiction. So the doctrine of original jurisdiction, especially in criminal proceedings is important. Without that the Government officials could basically keep charging you over and over again but in different courts seeking other jurisdictions. The Government gets a shot, the Government gets a fair chance, but just like the defense lawyer for Alec Baldwin said at some point it has to stop. And he is right i would agree with that. But the question is was the government misconduct so egregious and/or corrupt they were committing a criminal offense themselves? No i don't believe that. And that's where the danger could lie. You have a case where the investigative powers can not figure out who brought live rounds onto the set. But the evidence that the Baldwin defense filed a motion to dismiss on was evidence that was never on the set, these batch of live rounds. Why does that matter? Because those rounds were delivered to the Sheriff's office by somebody who was a friend of the father of the armorer who was a retired police officer, on the day the armorer was convicted of involuntary manslaughter. The live rounds came from Arizona they were not on the set. So the judge said look it i have to let the jury walk. But do those live rounds matter? Who knows right? But the investigation filed those rounds under a different case number. Dont know why they did that? Might be an ethics violation but really doubt this was some kind of obstruction of a legal proceeding involving the evidence of the case. But listen one guy said if you're making a western movie with a lot of gun action dont you get to point guns at each other? Absolutely not if it's unscripted. Scripted that might be a different story, but still doesn't change the law, still doesn't change the fact that it's a real gun or those guns used in the movie are real.
