The attorney general in and of himself appointing a special counsel is unconstitutional. It violates the appointment clause found in Article 2 of the Constitution. I know what Congress was trying to do, they were trying to create a legal structure that could hold anyone positioned in the executive branch of the Federal Government accountable to the legal system if they were abusing that executive authority and/or privilege. It's actually complicated and this is an oversimplification. But can such legal structure be Constitutional? I personally think it can be but the attorney general appointment would already have to be an attorney that has prior Presidential appointment and Senate confirmation and is currently active in the Federal Government and is not resigned and/or retired or is non current due to other reasons. He can be an appointment who was appointed by the current sitting President, or an attorney that was appointed and confirmed from a past Presidency and Senate so residual Government. So statute does stat that special counsel has to be a person of reputation. Jack Smith is not a person of reputation. As far as I know he's never been appointed by any President or was confirmed by any Senate. This is important because the appointment and the confirmation comes from elected individuals who were elected by the people. Our Government is supposed to come from the people and through the people, that's important because it's what the Constitution says. The Office of special counsel of Jack Smith was given to him by an unelected or a unrepresentive process. They want to govern and bring they're charges but they do not want to be elected, they just want to hold an Office and tell you what to do without the consent of the people (meaning without their vote). So there's that going on. Justice Scalia wrote a lone dissenting opinion in a case called Morrison v Olsen. And in his opinion he was saying that an independent counsel vests executive powers into others besides the President which is unconstitutional. The President is the head of every executive agency in the Federal Government, that means he's the head of all the Offices of the Federal Government. (He's also the Commander and Chief of the United States military). Independent counsel was an Office of the Federal Government that was not under the Presidency. Basically he's a free agent within the federal government. Last time I checked the Constitution does not give executive powers to free agencies. And this is how Jack Smith was appointed even if he's answering to the attorney general, he was still appointed out of free agency to head an Office and some of the executive powers are vested in him. He has a title of special counsel, but in ways he's acting as an independent counsel. Really don't see much of a difference.
